This Acceptable Use Policy (“AUP”) establishes certain rules and requirements pertaining to the use by customers and users (“You”) of the Avviato, Inc., (“Avviato”) websites, applications, products or services,, such as, but not limited to, Collaboratory and LlamaSite (collectively the “Offerings”). This AUP may be amended at any time, and such amendment will be effective at the time Avviato posts the revised AUP to its website(s). If You have entered into an Agreement with Avviato, this AUP is incorporated by reference into such Agreement. In the event of a conflict between the terms of this AUP and the Agreement, such as a Master Service Agreement, the terms of such Agreement shall govern.
1. Compliance. This AUP is intended to protect the users of Avviato’s Offerings and the internet community as a whole from improper, inappropriate, abusive, or illegal activity. When using any Avviato Offering, You must comply with this AUP, and You are expected to adhere to commonly accepted practices of the internet community. The prohibited uses described below are intended as minimum guidelines regarding improper and inappropriate conduct and should not be interpreted as an exhaustive list.
2. Prohibited Uses.
a. The Offerings may only be used for lawful purposes. You agree not to use the Offerings for any unlawful purpose or in any way that violates any applicable federal, state, local, or international law or regulation. This includes, without limitation, engaging in any activity that is illegal, fraudulent, unethical, or infringes upon the rights of others..
b. The Offerings may not be used in a manner which purposely alters or forges any person’s identity, deceives any third party, or impersonates any other party. You agree not to misuse the Offerings by engaging in any activity that compromises the security, integrity, or availability of our systems, networks, or data, or the systems, networks, or data of other users. Prohibited activities include, but are not limited to:
i. Unauthorized Access: Attempting to gain unauthorized access to any account, network, system, computing facility, equipment, data, or information that you are not explicitly authorized to access.
ii. Interference: Engaging in any activities that disrupt, degrade, interfere with, or otherwise negatively affect the ability of others to access or use the Offerings, including denial-of-service attacks, spamming, or any form of excessive or abusive usage.
iii. Monitoring: Conducting unauthorized monitoring, scanning, probing, or testing of any system or network for vulnerabilities or to gather information without written consent from Avviato.
iv. Malicious Code: Transmitting, uploading, or distributing files, code, or messages that contain viruses, worms, Trojan horses, spyware, malware, or any other harmful or disruptive software or code.
v. Security Circumvention: Attempting to circumvent or bypass any security measures, authentication procedures, or access controls implemented to protect the Offerings or related systems.
vi. Data Breach: Attempting to access, copy, modify, or exfiltrate data without authorization, or otherwise violating data protection policies.
vii. Attacks and Exploits: Engaging in any form of hacking, cracking, exploiting vulnerabilities, or conducting any other type of unauthorized attack on our systems or the systems of other users.
3. Data Types. You will not upload any of the following types of information: (a) personal health information, (b) driver license numbers, (c) passport numbers, (d) social security, tax ID or similar numbers, or (e) bank, checking, credit card, debit card, or other financial account numbers. You are solely responsible for compliance with all applicable data privacy and data protection laws in connection with your use of the Offerings, including obtaining any necessary consents. You will ensure that You have the right to collect, use, and share any data that You upload into the Offerings.
4. Your Responsibilities and Avviato’s Rights. You will cooperate with appropriate law enforcement and other governmental agencies and other parties involved in investigating claims of illegal or inappropriate activity. If You become aware of any violation of this AUP, You must promptly notify us at support@avviato.com. Avviato will investigate and address all reports of violations and/or abuse. Any account found to be in violation of this AUP is subject to immediate suspension. If You are an organization using the Offerings, You are responsible for ensuring that your employees and contractors adhere to this AUP.
5. Security and Data: You are responsible for maintaining the security of your credentials for the Offerings and for all activities that occur using your credentials. You must promptly notify us at support@avviato.com of any unauthorized use or suspected security breach.
6. Use of our API. The Application Programming Interface (API) is an optional Offering to authorized users, granted via a limited, non-exclusive, non-transferable, and revocable license to access and use our API solely for your internal business purposes, in accordance with our documentation. The following apply to the use of the API:
a. Restrictions: You shall not (a) use the API in any manner that violates applicable laws or regulations; (b) reverse engineer, decompile, or otherwise attempt to derive the source code or underlying structure of the API; (c) use the API to create a competing product or service; (d) share, sublicense, or otherwise provide third parties with access to the API without our prior written consent; or (e) use the API in a manner that exceeds rate limits or otherwise abuses the service, as determined at Avviato’s sole discretion.
b. Modifications and Availability: We reserve the right to modify, suspend, or discontinue the API, or any part thereof, at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the API.
c. Termination: We may suspend or terminate your access to the API at any time, with or without cause or notice, including for any violation of this AUP or abuse of the API.
7. Use of Artificial Intelligence. Our Offerings may offer optional features powered by artificial intelligence (“AI Features”). Your use of these AI Features is voluntary. You may enable or disable AI Features at any time by contacting our support team. If you choose to use AI Features, your use is subject to this AUP and any additional terms provided for those specific features. You are responsible for ensuring that your use of the AI Features does not infringe upon any third-party copyrights or other intellectual property rights. We are not responsible for any copyright violations that may result from your use of the AI Features. You acknowledge that the results generated by AI Features may not always be accurate or reliable, and we are not liable for any decisions or actions taken based on such results. You may opt-out of using AI Features at any time without affecting your access to other core functionalities of the Offerings.
